
PRIVACY POLICY OF THE ONLINE STORE SKLEPRESMED.PL
("Terms and Conditions")
This Privacy Policy specifies the manner in which ResMed Polska sp. z oo with its registered office in Warsaw (" ResMed " or " Administrator ") processes the personal data of the Store Customers who use it under the terms and conditions specified in the Regulations of the SKLEPRESMED.PL Online Store (" Regulations "), as well as the principles of collecting cookies by ResMed in connection with the provision of services electronically under the Regulations.
The Privacy Policy consists of three parts:
- Part I – general provisions
- Part II – information on the processing of personal data
- Part III – information on the collection of cookies

ResMed may change the provisions of the Privacy Policy. In such case, § 12 point 8 of the Regulations shall apply accordingly.
The terms used in the Privacy Policy, in the singular and plural, should be understood as follows:
- "ResMed", "Administrator" or "Seller" - ResMed Polska sp. z o. o. with its registered office in Warsaw at ul. Pokorna 2, lok. U18A (00-199) Warsaw, entered into the National Register of Entrepreneurs maintained by the District Court for the capital city of Warsaw in Warsaw, 12th Commercial Division of the National Court Register under KRS number 0000398211, NIP (Taxpayer's Identification Number) 5272667838, REGON (National Business Registry Number) 145839380, with the share capital of PLN 50,500.00;
- "Client" - a natural person with full legal capacity, a legal person or an organizational unit that is not a legal person but which has been granted legal capacity by law;
- "Account" – a service provided electronically, an individual and authorized Customer profile within which the Customer may place Orders; allows the Customer to use additional functionalities of the Store available only after creating an Account;
- "Regulations" - Regulations of the SKLEPRESMED.PL Online Store, available at: https://sklepresmed.pl/pl/i/Regulamin-sklepu-internetowego/1
- "Electronic Service" - a service provided electronically within the meaning of the Act of 18 July 2002 on the provision of services by electronic means (i.e. Journal of Laws of 2020, item 344), by the Seller to the Customer via the Store;
- "GDPR" - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
- "Cookies" – IT data, in particular text files, which are stored on the Customer's Device and are used to enable the use of the Store.
- “Client Device” – the Client’s telecommunications terminal device, including a computer or mobile phone.
For the remaining purposes, the definitions set out in the Regulations shall apply.
The administrator of the Client’s personal data is ResMed Polska sp. z o. o. with its registered office in Warsaw.

As part of using the Store, the following are processed:
- the Client's personal data provided during the registration of the Account and (if applicable) subsequently modified by the Client in accordance with the Regulations
The Client's personal data are processed for the following purposes and on the following bases:
- for the purpose of providing services electronically (including within the Account) – on the basis of an agreement concluded with ResMed based on the Regulations (Article 6, paragraph 1, letter b of the GDPR)
- in order to handle complaints regarding services provided electronically – based on ResMed’s legal obligations arising from, among others, consumer protection regulations (Article 6, paragraph 1, letter c of the GDPR)
- for the purpose of serving Customers (including answering questions other than those related to the Store or Account) – based on the legitimate interest of ResMed (Article 6, paragraph 1, letter f of the GDPR)
- for the purpose of marketing ResMed products and services (including sending information, presentations, messages and personalised offers regarding ResMed products to the specified telephone number, address or e-mail address) – based on the Client’s voluntary consent (Article 6, paragraph 1, letter a of the GDPR)
- in order to analyse the Customer’s data for the purpose of improving the quality of services provided within the Store – based on the Customer’s voluntary consent (Article 9, paragraph 2, letter a of the GDPR);
- to ensure accountability of personal data processing (including demonstrating that personal data are processed in accordance with the principles relating to personal data processing referred to in Article 5 of the GDPR) – pursuant to ResMed’s legal obligations set out in the GDPR (Article 6(1)(c) of the GDPR);
- in order to perform obligations arising from legal regulations (including tax or accounting regulations) – based on ResMed’s legal obligations specified in generally applicable law, including the Act on the provision of services by electronic means (Article 6, paragraph 1, letter c of the GDPR).
Your personal data will be retained by ResMed for the following periods:
- processing for the purpose of providing services electronically – personal data will be stored for the duration of the provision of Electronic Services in accordance with the Regulations and the handling of complaints, but no longer than until the termination of the agreement for the provision of services electronically, the final consideration of the Customer's complaint or the limitation of claims;
- processing for the purpose of handling complaints regarding services provided electronically – personal data will be stored for the duration of the complaint, but no longer than until the final consideration of the Customer’s complaint;
- processing for the purpose of customer service – personal data will be stored until you effectively object to their processing;
- processing for the purpose of marketing ResMed products and services – personal data will be stored until the Client withdraws his/her voluntary consent to their processing, but no longer than for 5 years from their acquisition;
- processing data for the purpose of analysing the Customer’s data for the purpose of improving the quality of services provided within the Shop – personal data will be stored until the Customer withdraws his/her voluntary consent to their processing, but no longer than until the Account is deleted;
- data processing in order to ensure accountability of personal data processing – personal data will be stored for the duration of the provision of Electronic Services in accordance with the Regulations, but no longer than until the termination, expiry or termination of the agreement for the provision of electronic services or the limitation of claims;
- data processing for the purpose of fulfilling obligations arising from legal provisions – personal data will be stored for the period specified in the provisions of generally applicable law.
Providing data is voluntary, but failure to provide certain data (eg data required to register an Account) may prevent or limit ResMed's ability to provide Electronic Services.
The Client's consent to the processing of personal data for the purpose of marketing ResMed products and services, conducting mailing or conducting telemarketing is voluntary and is not a necessary condition for using the Store. The Client is not obliged to provide such consent or consents. Failure to provide consent means that ResMed will not be able to use the Client's personal data for the purposes covered by the consent.
The Client's personal data may be made available to entities providing services to ResMed only to the extent necessary for the provision of their services, including services related to the Store and technical and administrative support services (eg entities providing IT systems and software maintenance). ResMed has concluded appropriate personal data processing agreements with these entities, guaranteeing the maintenance of appropriate personal data security standards. Access to personal data is only granted to persons for whom such access is justified due to the tasks performed and services provided.
In certain circumstances , as described in our DATA PRIVACY FRAMEWORK POLICY , RESMED relies on the EU-US DATA PRIVACY FRAMEWORK (DPF), the “UK EXTENSION TO THE DPF” and the “SWISS-US DATA PRIVACY FRAMEWORK” for data transfers from the EU, the United Kingdom and Switzerland to the United States . In such circumstances , RESMED complies with the DPF, the UK Extension to the DPF and the SWISS-US DATA PRIVACY FRAMEWORK, as set forth in our DATA PRIVACY FRAMEWORK POLICY .
- The right to withdraw consent
The customer has the right to withdraw consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
The Client has the right to object to the processing of personal data based on the legitimate interest of ResMed for reasons related to the specific situation of the Client. In a situation where an objection has been raised to the processing of personal data for marketing purposes, ResMed will not be able to process the Client's personal data. In the event of an objection to the processing of personal data for other purposes, ResMed will not be able to process the Client's personal data unless there are legitimate and legally valid grounds for processing that override the interests, rights and freedoms of the Client or grounds for establishing, pursuing or defending claims.
- Other Customer Rights
The Client has the right to access personal data concerning the Client, to rectify, delete or limit processing, as well as the right to transfer data. The Client has the right to lodge a complaint with the President of the Personal Data Protection Office in connection with the processing of personal data of the Client by ResMed.
- How to exercise customer rights
Zgoda Klienta na przetwarzanie danych osobowych może być cofnięta w każdym czasie poprzez:
- zmianę ustawień Konta w panelu służącym do zarządzania wyrażonymi przez Klienta zgodami
- aktywację linku wypisującego z subskrypcji zawartego w otrzymanym e-mailu zawierającym informacje handlowe
- kontakt z ResMed lub inspektorem ochrony danych osobowych (pkt 1 i 2.2 Polityki Prywatności)
Plik cookies (inaczej zwany „ciasteczkiem”) to mały plik danych, zazwyczaj plik tekstowy składający się z liter i cyfr, ustawiony przez strony internetowe ResMed (są to tzw. „nasze pliki cookie”) lub inne strony internetowe, które dostarczają treść lub funkcje na stronę internetową Sklepu, którą przeglądasz (są one nazywane „plikami cookies osób trzecich”).

- Niezbędne – pliki cookies, których wykorzystanie jest niezbędne do korzystania ze Sklepu;
- Analityczne – pliki cookies, które przechowują informacje o sposobie korzystania z Sklepu stosowane dla poprawy funkcjonowania i bezpieczeństwa Sklepu;
- Funkcjonalne – pliki cookies, które umożliwiają „zapamiętanie” ustawień wybranych przez Klienta dla ułatwienia korzystania z Sklepu przez Klienta;
- Reklamowe – pliki cookies, które umożliwiają wyświetlanie spersonalizowanych reklam dla Klienta.

Oprogramowanie do przeglądania stron internetowych zainstalowane w Urządzeniu Klienta („Przeglądarka Internetowa”) umożliwia zarządzanie ustawieniami plików cookies. W zależności od stosowanej Przeglądarki Internetowej, Klient może zmieniać te ustawienia, na przykład by wyłączyć domyślną obsługę plików cookies, ustalić które pliki cookies mają być blokowane lub usunąć zapisane na Urządzeniu Klienta pliki cookies.

Changes to settings, including limiting the use of cookies or opting out of using cookies, may affect some of the functionalities available in the Store, and may also prevent you from using the Store.
- Use of cookies by the Administrator
The Administrator may use cookies within the Store and the provision of Electronic Services, i.e. files with information that are saved by the Administrator's server on the Client's Device.
Cookies are used with the Customer's consent. The Customer expresses consent through the settings of the Internet Browser installed on his device.
Cookies generally do not contain personal data. In the event that the data stored in cookies, either individually or in combination with other information, constitute personal data, the principles of personal data processing specified in point 2 apply.
Personal data contained in cookies are processed for the purposes for which the cookies are used, based on:
- the necessity of processing such personal data for the provision of Electronic Services (Article 6, paragraph 1, letter b of the GDPR) – including in the case of personal data processed in cookies used for technical configuration purposes;
- ResMed’s legitimate interest (Article 6(1)(b) of the GDPR) – including in the case of personal data processed in cookies used for security and performance purposes, Customer support or analytical purposes;
- the Customer's consent (Article 6, paragraph 1, letter a of the GDPR) – including in the case of personal data processed in cookies used for advertising purposes.
Personal data contained in cookies are processed for the period specified for cookies.
